chief justice of the constitutional court takes on case against the IEC

CHIEF JUSTICE OF THE CONSTITUtIONAL COURT ISSUES DIRECTIONS The Chief Justice of the Constitutional Court in Braamfontein , Johannesburg has issued directions in the matter between the AFRICA UNITE party and the IEC case No.CCT 45/14. The case against the IEC is whether the security deposit required under the IEC constitution shows “seriousness” or infringes on the Right to Stand for Public Office under Section 19, b of the Bill of Rights. Mr. Denton, President of the AUP has brought the case against the IEC; to the highest court in the land to decide this issue once and for all; and for all South Africans. The Chief Justice issued directions on the 28th March- only two days after the urgent application was submitted to the court by the AUP. In terms of Rules of the court the following timetable of directions has been issued to both parties. The IEC has until Monday, 31st March, 2014 to oppose the application (which they have done) and until the 3rd of April, 2014 to set out the grounds of its opposition. The AUP has if it so wishes until Monday, 7th April 2014 to submit its response affidavit and until the 8th of April its written argument on the merits of the application. The IEC has until the 10th April to oppose the result of that process. This is the first time that a political party has applied for direct urgent access on this matter in South Africa; and if it is successful, it will change the political landscape of our constitutional democracy and make the elections more free, fair and credible. It will also be a first in the world where this issue has been tested under constitutional parameters; and may set a precedent to give minority parties a greater voice in future elections. A copy of the directions were also sent to the attorneys of the Economic Freedom Fighters (EFF) as an interested party and the Johannesburg Society of Advocates. No comment has been issued from either office as of yet; and the AUP have not entered into any discussions with the EFF.

AFRICA UNITE CHALLENGES THE IEC IN CONSTUTIONAL COURT

IN THE CONSTITUTIONAL COURT OF SOUTH AFRICA (HELD AT BRAAMFONTEIN) Case No. In the matter between: AFRICA UNITE PARTY Applicant And CHIEF ELECTORAL OFFICER OF THE INDEPENDENT ELECTORAL COMMISSION Respondent NOTICE OF MOTION KINDLY TAKE NOTICE THAT the applicant intends making the application to the above honorable court on Monday, 24th March, 2014; or as soon thereafter as the matter may be heard for an order in the following terms: 1. Condoning the applicant’s non-compliance with the form of service of process as provided for in the rules of the above honourable court and dealing with this matter on an urgent basis in terms of Rule 12 of the uniform Rules of the above honourable court. 2. Granting the applicant leave to appeal against the decision of the Electoral Commission on the 24th March,2014 under the non compliance notice to pay the substantial deposit of R200 000 to contest in the National Elections on the 7th May,2014. 3. Setting aside the decision of Judge Raulinga in the High Court in Pretoria on March 12th that all parties should pay this deposit to the Electoral Commission because it shows or guarantees “seriousness” to stand for public office. 4. 4.1 Declaring that the Africa Unite Party (AUP)is eligible to be on the list of candidates of the National Elections because it is in the public interest for it to be; and 4.2 Declare that the large deposit of R200 000 for one candidate should be waived as it infringes on this individual’s right to stand for public office according to the Bill of Rights; and thereby disenfranchises the electorate who are concerned with the issues of racially motivated violence in this country, the economy, corruption and the youth; thereby not making this election free, fair or credible for all; but dependent on the economic status of said person or party. 4.3 A review of the registration process of political parties in this country by the IEC; and how constitutional democracy can be best served according to the guidelines of the Electoral Commissions Act 1996( part 4 “ objectives”) ;so that every voice in this nation who wishes to be heard are included in our election process without fear, favour or prejudice to any. 5. Further and alternative relief. 6. Costs of this application should the respondent oppose the relief sought. I am not a qualified attorney but representing myself as the applicant in this motion. If it pleases the court to appoint an attorney to act on our behalf we will not object; but we remind the court that we cannot afford an attorney at this time to represent us. We have supplied our address of 117 Strand Street, Crystal Park as the offices for the AFRICA UNITE PARTY who are the applicants. 2. I am duly authorized to bring this application on behalf of the Party and act on the directions of the Secretary and Vice Chairman/President of the applicant. 3. The facts contained in this affidavit are, unless otherwise indicated, within my personal knowledge and are, to the best of my belief, both true and correct. I gained personal knowledge of the facts as the founder and leader of AFRICA UNITE PARTY and as an interested participant in standing for public office in the National Elections in May,2014. The Parties 4. The applicant is the AFRICA UNITE PARTY, a political party registered to contest elections in terms of the Electoral laws of the Republic of South Africa having its headquarters at Sondela House, 117 Strand Street,Crystal Park , Benoni. 5. The respondent is the Chief Electoral Officer appointed as such in terms of the Electoral Laws of South Africa as such at Elections House, 1303 Heuwel Avenue, Centurion, 0157. The purpose of this application 6. The purpose of this application is the following : 6.1 Condoning the applicant’s failure to comply with the timeframes set in the Rules of this honourable court for service and filing of process and dealing with this matter on an urgent basis. 6.2 Granting the applicant leave to appeal directly to this honourable court against the ruling of the High Court dated 12th March,2014 as an interested party and amicus curiae ,insofar as it declares that placing a large deposit with the IEC shows “ seriousness” that Mr. Denton( who is the sole candidate of the AFRICA UNITE PARTY) intends to stand for and contest the National Election as leader of his party; a party registered by the IEC in accordance with the Electoral Commissions Act on the 7th March,2014. That it is not in the interests of our constitutional democracy to exclude smaller parties on the basis of financial means. 6.3 Granting the applicant leave to appeal against the decision of the High Court and/or the IEC to stand for public office for the reasons stated in this affidavit. 6.4 Setting aside the decision of the Electoral Court /and or High Court to place a substantial deposit in order to run for public office in the National Elections. 6.5 Declaring that Mr. Denton is eligible to be on the list of candidates and that his party is also eligible to be on the lust for National Elections because it is in the public interest of this country; and 6.6 Declaring that Mr. Denton does qualify for inclusion on the list of candidates for the elections to be held on the 7th of MAY, 2014. 7. Further, to declare that placing a large deposit with the IEC does not show “seriousness” nor is it necessary to show that a party is eligible to run in the National and/ Provincial elections. That it is enshrined in our constitution in the Bill of Rights and healthy for the progress of our democracy to be inclusive not exclusive, so that every voice may be heard in this process. Factual Background and context 8. On 18th March 2014, the respondent objected to the candidacy of AFRICA UNITE PARTY ( AUP) by sending a non-compliance notice to the party’s email. A copy of this non compliance notice is attached marked ;AUP1 9. The IEC acting within their constitution and timetable did so to give all parties a reasonable time limit to comply with any outstanding requirements. These requirements the AUP have complied with willingly with the exception of the payment of R200 000 which this party disagrees with and believes is unconstitutional as it precludes our sole candidate from standing in this election. The applicant offers the court the following explanation: a. Under Section 3b of the Electoral Commissions act the IEC has a mandate to ensure the elections are free, fair (and credible). But what does the very term “ free and fair” really mean if by very definition of those words the rights of the individuals concerned and parties concerned are infringed by the compulsory payment of an exorbitantly large amount of money to stand in and to contest the elections ( considering also that smaller parties do not get any money from the IEC to campaign with if they are not already standing in parliament),this gives an unfair advantage to other parties who have limitless funds to campaign with. There is NO level playing field at all as a result. b. The Bill of Rights under Section 19-24 states that anyone who is a South African citizen may stand for public office. This also guarantees the right or freedom of assembly, to form a political organization or party to express the will of the people in a free atmosphere, a free environment and a free and fair election- which will determine the outcome of the will of the people. c. The word “fair” means exactly that – which a fair or equal platform where all voices have the possibility to be heard. If those voices are excluded because of financial abilities or restraints; the election is no longer “free” or fair…or credible. If this were so then the IEC would have failed in its duty of care to the South African people; and in their objective to promote constitutional democracy. Furthermore, the argument of other countries and what they do is not relevant here. We are not a first world country yet; and many of those people whom we represent do not have the wherewithal to contribute on the same levels as others do in richer nations. We are still a young democracy. d. The voice of the people must be heard without fear, favour, and prejudice including financial prejudice. It is their right under our constitution. e. Finally, The AUP is currently in the midst of a serious case against the state president Mr. Zuma for theft, fraud and corruption (Docket No 1046). If this party were not serious in its intentions to serve the people of this country ; they would not be standing for elections or contesting in court against injustice. Also many of the country’s people who are affected by racial violence do not feel they have a voice in parliament. Red October is one such organization. They have sent a public petition to parliament in October of last year and have so far not received a response from the speaker. We therefore contend that not only is it in the public interest that we contest in these elections; but that for a single solitary candidate to pay such a high deposit makes this election no longer free, or fair…or constitutional. The applicant further attaches copies of the charges laid against President Zuma showing that we as a party are indeed serious in our intentions to serve the people of this country AUP2; we also submit the Constitution of South Africa as exhibit AUP 3 and the Ballot sheet printed by the IEC on the 19.03 2014 after the signing of the Code of Conduct – which this party signed first. AUP4. As a precedent to this ruling I would like to suggest the honourable court also read the comments of Judge D Mlambo P 14 ( 27) , Judge President of the Gauteng Division of the High Court of South Africa in Pretoria at the matter between the media and Oscar Pretorius Case NO 10193/2014 – AUP5. In this the honourable judge refers to our democracy as young and the people finding it difficult to access the justice system because of their financial restraints. Similarly, if our elections are to be free and fair and comprehensive, we need to give everyone a chance to be heard and to choose whosoever they desire to represent them. If the IEC places such a huge obstacle in the way of new fledgling parties to contest; many of those voices will be silenced. As the justice system should not be for the rich and the famous… so too should the electoral process not be for the economically advantaged. The objects of the Commission, as defined in section 4 of the Electoral Commission Act, 1996, are to strengthen constitutional democracy and promote democratic electoral processes. At the moment this isn’t happening. 10. A better way has to be found for full representation. And this should be the new challenge for the IEC in the years to come. What we are asking the honourable court now is for a chance to make a difference in our country. We are serious. 11. The AFRICA UNITE PARTY has so far complied with all the requirements of the IEC and wishes to contest in these elections. We cannot pay the required deposit money and we feel that on principle it is not fair that we pay. We have shown the IEC and South Africans that we are acting in good faith to represent their concerns and to be their voice. All we are asking this court is to uphold our constitutional right to stand for public office and to give us a chance to show what we can do. 12. I would like to say that Mr. Denton is an upstanding member of the community and is of good character. In light of the fact that we are already on the ballot sheet ; we are in the process of participating in a very high profile case that concerns all South Africans, and that we are serious about standing in these elections; we ask the courts indulgence to waive this unfair requirement to pay the R200 000 deposit. Urgency 13. It is my contention that this matter is urgent. We are in the middle of a campaign and we have to put it all on hold if we cannot contest in these elections. Many people will suffer as a result because they have looked up to us to represent them. The IEC have given us until today to comply with their requirements. 14. We have until the 10th April to appeal to the Electoral Court for our non compliance. If this court rules in our favour we will have a chance to contest in this year’s election. We have to show the IEC just cause for non compliance. This is why we have come directly at this time to the esteemed constitutional court to protect our rights under the constitution to stand for public office. 15. The applicant has approached the court at the first available opportunity. Since signing the Code of Conduct and trying all other avenues to comply with the IEC requirements; we have seen this is our last recourse for justice. Wherefore, I respectfully pray for an order in terms of the notice for motion to which this affidavit is attached. let them eat tomatoes!

Let them sell tomatoes! It’s quite interesting that Marie Antoinette the French queen who allegedly said: “Bread- Bread?-Let them eat cake”…didn’t actually say that …but the quote was ascribed to her… so she got a bad rap from history because of that… TOO BAD MARIE! For those of you who don’t know anything about the French Revolution… Marie along with many other royals who oppressed the people by opulent wealth …eventually lost their heads by guillotine... Today…in South Africa… people don’t lose their heads by guillotine…they just get rewarded OR Necklaced…- OR shifted to another position of power and forgotten about… they are not sanctioned…they rarely go to jail…and they never -never pay the money back… we live in a great land of great possibility…and opportunity… but we also live in a land whose problems are very much self inflicted… the poverty..the poor public services and the unemployment has little to do with what happened 20 years ago…and much to do with the climate of greed and the Orwellian Animal Farm that exists in South African Politics. It really is hard to tell the difference between the pigs and the men… But we are told the ruling elite will get reinstated again and the people will vote them in with an even greater majority… I sincerely think to myself..if this be so… then we are a country of pig ignorant stupid people who can’t call a spade a spade.. (no pun intended) ..And we cannot call a thief and thief… Take President Zuma for example. I laid a few charges against him on Friday which is human rights day…named so after 69 people that were massacred on that day many years ago in Sharpville. It was a tragedy… but what do we see on TV…? Zuma jumping up and down like a frog. Again… it’s like saying …” I stole your money…I’m SO FREEKING great because you LOVE me for it -and you don’t mind living in shit…and if you don’t have money to eat because I stole the bread from the mouths of your children… well… “You can go sell tomatoes…” ( lol) Now, let me say this for the record… I’ve actually heard one very high up person in the NAC actually use this phrase. I am not going to embarrass him… why? Because … he is the one who is out of touch..Ignorant…like the French royals were …and indeed the Russian royals…only 100 years ago. ( 1917)… Europe was really out of touch and certainly not socially minded..it took two bloodbaths to actually wake people up and give them empathy for each other. The people in this country need to be conscietised. They are fast asleep …they actually believe that the ruling powers would never harm them or do something bad… why? Because they don’t know any better. It is indeed a strange thing that the British people actually almost worship The royals… and yet… they too were and are responsible for so much wholesale theft from the people. Perhaps it is a deep trait within us to want to be exploited and abused…I don’t know… I do know that a man who spends R807 782 or 70 000 USD on pumping shit… must be full of it… that is what a sewerage station in Nkandla cost the taxpayer… just for pumping excrement… what the hell is that? The majority of people in the area still use holes in the ground. But seriously… that is what the elite in the ANC think. If you are poor you can sell tomatoes on the side of the road…if you are homeless…you can sell tomatoes … and if you need urgent medical attention but can’t afford medicine… you can sell tomatoes… Tomatoes cure everything… all economic ills we may face in the future and is a panacea to the poor… so it then becomes so easy to allay your guilt… You can tell the poor not to eat cake but to sell tomatoes… that should always do the trick. And so far it has. As long as South Africa continues with this poverty mentality it will always be a substandard nation …3rd world… pretending to be first world… all gloss and no shine… all skin deep but no true depth…. HUMAN RIGHTS DAY...CALL TO IMPEACH THE PRESIDENT!

Today, on this day to celebrate Human Rights...let us not forget the sacrifices made by those in this country who fought for freedom and peace and prosperity for all. Who suffered- who died... who fought ...who cried... it is they , those faceless ones we should recall. And let us who remain remember we have a duty to uphold the rights of all citizens who simply want to live decently. WHO WILL GUARANTEE THEM ...THEIR HUMAN RIGHTS?...PRESIDENT JACOB ZUMA? HELL NO! Media Release 21ST March, 2014, Human Rights Day The Africa Unite Party stands with the EFF and the DA to call for the swift impeachment of the president of the Republic of South africa on corruption charges following the Nkandla report of Thuli Madonsela. We as AFRICA UNITE dedicated to Human Rights and transparent government have decided to take a stand against the misappropriation of public funds by Mr. Zuma. We feel it not only discredits our nation in the eyes of the world but also all of our citizens and those who have had faith in the ANC as a political organisation with integrity. Today on Human Rights Day we will be holding a protest outside Johannesburg Police Station( John Vorster Square) from 10 am and we will also be laying a charge against the president for misuse of public funds ,racketeering and corruption. No longer will our public servants help themselves to the taxes we pay and divert funds sorely needed by our people for their own benefit. No longer will our president or his cronies steal bread from the mouths of our children or medicine from the hands of our aged. To make poverty history;... we must make Zuma history! We cannot allow this man to stand for another term in office until he has made right with our people.He must stand down. He must resign. Africa Unite will zealously guard this countrys' Bill of Rights and its Constitution and stand up for the weak, the vulnerable and the oppressed. We will not allow our nation to degenerate into chaos through the corrupt actions of one man and his cronies We deserve the government we elect. If we elect thieves into government and do nothing; we deserve to starve.Therefore, it is time..the time has come for NEW leadership in this country. You deserve better!

we achieved the impossible yesterday. I was the first poltical party in south africa to sign the code of conduct. I was quite nervous so i kept my speech short and sweet. now we have to climb the cliff face...we need to get into parliament. To do this i will have to canvas for around 50 000 votes out of a potential 25 million. Then I get a seat. I also have a deadline to give a deposit of 200 000 rand.- approxiamately 12 000 pounds or 20 000 dollars USD. - we have raised as a... party around 70 000 rand in pledges which means we are 130 000 short. and 4 days to do it in... ...we get the money back if we get the seat ...if not we lose the deposit... thats our democracy - crazy i know... but the AFRICA UNITE PARTY isgrowing by the day. People are sick and tired of this thief mr zuma stealing money to fund his many wives and girlfriends and ignoring the plight of the people he is supposed to serve. The ANC in their arrogance seem to think they are NOT accountable and that Mr. Zuma doesnt have to pay the money..imagine if this were a first world country- which this country aspires to be... imagine the outcry if the prime minsiter of england were to spend so much of the publics money on his own personal house... HE WOULD BE OUT IN A DAY!...on the street or ...better still... in jail. The sad thing about all of this is that the people will still vote him in and they will still continue to suffer and go hungry...while these dogs will steal the bread from the mouths of the very people that put them into power... why? because they havnt been fully politcised...they seem to think we are living 20 years ago...not in the 21st century in a free and democratioc country where people cant just put their hands in the cookie jar and expect to say...oh...i didnt know. If this is so...if this be true...if the ANC is really reelected into power... then all I can say is... you deserve the goverenment you elect. STOP SUFFERING! If you are starving...its because you elected thives to govern you. If you get robbed, raped or killed...its because you elected robbers,thieves,rapists and murderers into power. But if you truly believe that south africa is what Nelson Mandela said it should be...a rainbow nation... a nation of many colors living together in peace and living in prosperity as one nation under God... then drop the ANC , drop the EFF, drop the DA and vote AFRICA UNITE We are a peoples party ...and WE SHALL govern...if not this election...and not the next one in 2019... we shall capture the peoples heart and they shall one day see our intentions are pure. To see South Africa blossom one day into the nation it is supposed to be. I may not be there when it happens; but others will pick up this baton and run with it when the time comes. something inside so strong!

Something inside so strong Angels surrounded me as I heard the Soweto Opera Quadro singing on stage and I began to pray to God in the Spirit saying : Baruch Hashem- Blessed is He who comes in the Lord. Adonai- Elohim…it was as if there were angels and I could feel them all around me…. And as I sat there on that stage listening to that beautiful music it felt that the doors of the heavens had been opened for me… and it was then that the Holy Spirit…GOD in all His glory spoke to me…. And said…. “The earth is the LORD's, and everything in it, the world, and all who live in it”;( ps.24.1) FOR THE EARTH IS THE LORD'S, AND ALL IT CONTAINS.(1.cor.10.26) You see I have been worrying about if I would have enough money to run in this election…and God was just telling me..Robin… don’t be silly- EVERYTHING…. EVERYTHING… belongs to ME… ALL THE MONEY ALL THE WEALTH EVERYTHING. What’s a few thousand dollars? – we get so hung up on it all….if God wants me to be in this election…HE will provide..why? because everything IS His… It’s that simple. I don’t need to get worried or angry about it. The money will come if it truly is God’s will. And what is the message for us all? We must trust in God. UNBELIEVABLE GRACE!- WE ARE IN!-WONDERS NEVER CEASE...

As of Tuesday night 13 political parties had submitted their lists of candidates. These were: the Africa Unite Party, the ANC, the African People’s Convention, the DA, the Minority Front, Vryheidsfront Plus, United Christian Democratic Party, Ubumbano Lwesiwe Sabangoni, Sindawonye Progressive Party, Al Jama-eh, the South African Progressive Civic Organisation, the Inkatha Freedom Party and the National Freedom Party. Parties who register before the deadline will be informed of any non-compliance by March 18, the IEC said. They would be given until March 24 to rectify this. The final list of candidates would then be made public from March 28 to 31, during which time they would be made available for inspection. The public would then have until April 1 to object to any candidate. Registered voters outside of South Africa were also given until 5pm on Wednesday to register their intention to vote. Submissions could be done online at www.elections.org.za. Voters are required to complete and submit the VEC10. So far 23,600 VEC10 notifications have been received. Overseas voting will take place on April 30 at South Africa’s 123 High Commissions, embassies and consulates-general in 108 countries. SO the prophet must be laughing his head off... I myself was simply gobsmaked. It appears we have crossed a major hurdle on our journey to make a big difference in this land... the hurdle of UNBELIEF!,,,,yes... we can!... we can do all things with faith in God. Africa Unite-for the record



Africa Unite Party ( A.U.P.) was registered on the 7th March,2014 at the Independent Elections Commission ( I.E.C)offices in Pretoria, South Africa.It is not only Africa's newest political party but it is the only purely Africanist party in existence today. The vision of the AUM (Africa Unite Movement) is to establish good,ethical and accountable governance across the entire continent.

The party founder and current president is Mr. Robin Denton who is based in Johannesburg, South Africa and is himself an ex- anti apartheid and human rights activist. The mission of the party was made clear in an interview with the SABC (South African Broadcasting Corporation) whereby it was stated that the party would be highlighting the high levels of extreme violence in South Africa, unemployment and corruption. The party describes itself as a pragmatic movement that has its sights not only on South Africa - but the entire continent of Africa. It claims over 100 000 supporters and will be contesting in elections throughout the country.

It is currently challenging the ruling of the IEC to pay a large deposit to run in the elections in the constitutional court.

The Oscar Pistorius trial... was it premeditated ?


SORRY ABOUT THE PHOTO...BUT I WANTED TO EXPRESS A POSSIBLE EXPRESSION...

The point in this whole trial is this...did he think to himself before he pulled the trigger... "mmm im gonna kill the bitch"...if so...its pre...meditated by definition. the prosecution has to prove this... and so far it hasn't. what happened is probably he lost his cool and shot reeva in the heat of the moment - without premeditation ...its called in France...a crime of passion...and in other countries ist degree manslaughter. not murder. I believe this is what happened. temporary insanity. what we need to look at is this what is in the interests of justice in this case. I believe we need to look at violence in our country and reckless gun crimes as serious matters...we need to highlight ALL violent crimes against ALL south African citizens...we need to stop it and to speak out against all of it...and that is why the AFRICA UNITE PARTY will stand by ALL the victims and their families of violent crimes against women, men, children white or black...farmers, and all citizens of our great country. The govt is not doing enough to stop the violence and that is why they need to be removed from power by all and every democratic means at our disposal.

If Oscar goes to jail...and I personally think he will... ( but not for life)... he will be a great example and a help to assist in the reform of our terrible prison system. We have some of the most violent prisons in the world and the 9th largest prison population in the world ( 150 000)...which goes to show that the leaders of the ANC have no concern to change anything in this country for the better...all they want is the cream... and many of them suffered in south African jails during apartheid... and yet... they have NO empathy for prisoners being raped and assaulted in our prisons and the dirty overcrowding going on....

Our party will curb male rape and extreme violence in ONE shot...how?

1. We will introduce conjugal visits for ALL prisoners.
2. We will introduce strong rehabilitation and reeducation programmes eg psycho drama/psycho therapy.  and facilities to assist inmates to study and further their workskills whilst incarcerated.
3. Promote the arts in prison through the VULINDELA TRUST.

Oscar can still be of great benefit to our nation and he will come out of prison after around 6 years having done something constructive for our people. I believe this. Too many people in this country of wealth and power ignore the plight of our oppressed and poor ...and this must end.

We will support Oscar through this process as well as the Steenkamp family.

Africa Unite! Party is born...

Ecstasy...is all I can say... I am ecstatic - today I got the news that the party has been approved by the IEC and we are on our way to contest in the next elections providing we can come up with the minimum deposit to do so. This will be the next hurdle. The fact that we have come this far in such a short time is quite incredible and is an amazing testament to the power of faith and prayer and steadfastness.


We can do ALL things through Christ who strengthens us.


I was anointed as the president of the new south Africa in exile. We are small but we are strong. We have only prevailed because we have been obedient to the Word of God and to the calling of God to stand up for the victims of violence and crime in South Africa...and for righteous government.


This land is a land which I have struggled for in dark times and in good times.... I stood up against apartheid when it wasn't popular... when the colour of your skin determined your worldview... but I went against the tide because I believed the struggle was about  what was right and true and just for this country. I NEVER in my wildest dreams thought I would start up a political party and movement. But the tide of history has again pricked my conscience. This time in favour of our former oppressors who have themselves become victims of murder and violence and apartheid by the new laws of this land.


As an Englishman growing up in the old south Africa , I experienced terrible bullying whilst at boarding school by racist Afrikaner Boers. It was so bad that I was forced to finish my schooling through correspondence school. I should in fact have no empathy for the predicament of the Afrikaners. But...I do...why? because I am firstly a patriot of this land and a Christian. I fought for what I believed was right by refusing to participate in a racist regime. I was right. Then I left this land again in 1999 as I saw the dream of a rainbow nation was being lost by the very racist laws that led to apartheid in the  first place. Now I see that the only way forward is not to run away...not to go somewhere else and complain or criticise....NO... the only way forward is to dive in...participate in the democratic process as a voice in the wilderness... a voice of truth, justice and righteousness.


And that is our mandate. We will stand up for ALL the weak...and ALL the vulnerable - irrespective of race....or credo. It is our mission to bring about good - accountable government or to at least be a voice that speaks its mind without fear or favour.


If something is wrong we will speak out against it.If something is unjust we will go to court to challenge it. But whatever happens...we will not simply let things be.... we have a longer road to freedom to travel than Mandela walked on...why? because our vision is for the entire continent of AFRICA.....


And that is why we celebrate the birth of the NEWEST political party of the spectrum in our rainbow nation...

What is an African? What is an Africanist?







There is only ONE race...that is the Human race. Robert Sobukwe, one of Africa's greatest visionaries and pan afriocanists understood something so profound when he said this. Unfortuantely , those who took up the baton from him in 1978 did not. They became engrossed in the black- white thing and were not able to feel the vision which came from Roberts heart... it was a very difficult time in which he lived...and sadly he never got to see the freedom of south africa from white apartheid.... nor the subsequent resurrection of black apartheid in 1999.
But I have livwed though both disasters. And now we are sitting on the eve of another one should the ANC get a 2 thirds majority... but they wont. There is a NEW middle class of black african...11 million of them who although they may have directly BENEFITTED FROM THE ancS BRIBERY AND CORRUPTION...THEY ARE BEGINNING TO UNDERSTAND THAT THE PARTY HAS INDEED LOST ITS WAY!

Think of it like this.... the ANC is the OLD TESTAMENT... as is the PAC... the DA is like the KORAN and the AFRICA UNITE PARTY is the NEW TESTAMENT.

WHY?

Because we have the way, the truth and the life on our side...as well as the knowledge and the vision to take this country out of its decay and bring it into the 21st century... it is the spirit of robert sobukwe in action. Africa Unite is also the spirit of the freedom charter in action... and even for the lost afrikaner... or the angry youth that Malema IS TRYING TO PREACH TO... the AUP is what this country and the continent needs to make things work again... and thats why ..I invite you all to join this movment...we are going to become in 10 years the largest African polticla movement to ever exist on this continent...

why?

because we have the vision..we are the true africanists who care about this land and its people...whio want to see it live and prosper and the wealth of its resources be shared amongst all...

You wont get that with the other parties... why?

because all they care about is power and money... and self importance...

Constitution of the Africa Unite Party

(Also Known as “The Africa Unite Movement” /A.U.M. or A.U.P.)

28th January,2014

1. PREAMBLE

1.1. The Africa Unite Party ( Hereinafter known as AUP/AU) subscribes to the principles of the Constitution of the Republic of South Africa and the spirit of the Freedom Charter.

1.2.The formation of the Party is the result of a comprehensive consultation process with the disenfranchised people of  South Africa.

2. NAME,EMBLEM,FLAG AND COLOURS

2.1 The Name of the Party is The AFRICA UNITE PARTY( AUP). As an awareness movement it is also known as the AFRICA UNITE MOVEMENT( AUM). The name shall not be translated and the abbreviation
( AUP/ AU )will be used in all the official languages of the Republic of South Africa.



2.2 EMBLEM

The Lion and the Lamb. It represents the strong protecting the weak and living in harmony with each other. The lion also represents courage and strength whereas the lamb represents sacrifice and purity.
It is inspired by the scripture: “ The wolf shall dwell with the lamb” (Isaiah 11.6 & 65.25).

On the our beret the golden shofar emblem (or trumpet) is the symbol used in ancient times to announce important events or to rally the people to action.

2.3 COLOURS

The colours of the organisation are red and white.

Red symbolises the blood of those South Africans who have sacrificed their lives for this nation as well as the innocents who have perished needlessly.

White symbolises purity, redemption ,reconciliation and restoration.

Also this was inspired by the scripture : “ And He said : “ What have you done? The voice of your brothers blood cries out to Me from the ground.” Gen.4.10



2.4 FLAG

The flag shall be either the lion and the lamb in red on white with the two words “ AFRICA UNITE” or simply the emblem in red on white background. We will also have an inverted emblem in red on white in some circumstances. Generally it will have just the lion and lamb in red on white background.

3. AIMS AND OBJECTIVES

3.1 The Party shall strive to unite all South Africans of all minorities on the principles of justice, peace, prosperity and righteousness for all. These principles will be guided by the National Constitution and the desire of all South Africans to build this country together for the betterment of all.

3.2 The Party shall always consult with the community in the spirit of Ubuntu and promote good governance based on shared responsibility. The Party will never impose its will on the people but will always uphold the principles of agreed consensus and democracy.

3.3 The Party shall expose corruption at all levels of government and public services and shall hold those responsible to account in a court of law.

3.4 The Party shall endeavour by all and every means to carry out the vision of our founding president Nelson Mandela to “ MAKE POVERTY HISTORY”.

3.5 The Party shall work tirelessly to unite all the people of all tribes, races and creeds and eliminate all forms of existing apartheid whether it be gender, economic or any other legislation that impedes the progress of this country’s liberation struggle . We shall also strive to defeat any form of national oppression or apartheid in the constitutional courts , parliament and abroad using any and every legal and just means.

3.6 Defend the progress of the people in their evolution towards a better society for all ;according to the will of the people based on the universal suffrage of all voters in this nation.

3.7 Fight for social justice, create free healthcare based on a universal health insurance , free schooling for all up to 16 as well as college grants and bursaries for those who merit them , toll free roads and unemployment allowances for all its citizens. We shall endeavour o expose any elitist, reactionary and unbalanced class that sets itself apart from the people by their corrupt actions.

3.8 We shall create an “ Empowerment Charter” that will be inclusive for ALL South Africans and not the select 1%. We  will ensure Financial Literacy is taught in schools and we will advocate the distribution of shares to all South Africans as part of this promise to the people to “ make poverty history”. We shall lobby all the governments and business institutions around the world to promote South Africa as a Business Destination and create jobs through foreign investment. We shall also endeavour to reduce the rate of unemployment by 10 % in the first 5 years in government.

3.9 We shall promote the Universal Human Rights Declaration and provide legal aid for those who would challenge the violation of any basic human right. Any form of discrimination or human rights abuse will be challenged in the open debate, court and the media and never, never tolerated.

4. THE VISION AND MISSION

4.1 Vision

To create an organisation or movement which is the home for all people irrespective of their status, culture, creed, race or gender. To protect the rights of the dispossessed, the disenfranchised and the disillusioned.

4.2 Mission

The mission of this movement is to establish justice for all as enshrined in our constitution, the Freedom Charter and the words of our founding fathers.    


We affirm Nelson Mandela when he spoke at the Rivonia Trials about domination of any people group towards another. We will successfully distribute the abundant wealth in this country to the poor and we will reverse the shocking crime statistics that have turned this into a “ criminal culture” with the 9th largest prison population in the world. We intend to break the power of the cartels and monopolies in this country and the unfair system of “ favouritism, elitism and nepotism”. This is the root cause of crime in this nation and must be abolished by any and every legal means at our disposal.

We also intend to reverse the brain drain from this country and improve the delivery of public services such as hospitals and schools so we can compete on an international level with any nation in the world. We shall promote volunteering in this country and NGOs who wish to work in our communities and not hinder them in their good work for our people. We shall cut waste and endeavour to become more green with our energy requirements.

We shall lobby for carbon taxes on irresponsible industrialists and reward good companies with oxygen credits if they invest in green projects and social justice. We will create a meritocracy in this country that gives access to all to any of the benefits this country has to offer. We shall never exclude anyone from anything because of the colour of their skin or their tribe or their religion or their gender or their creed. We shall also promote Pan-Africanism to improve our economic and political footprint in Africa for the betterment of all Africans. Genuine Refugees are welcome but those who are criminalising our country will be imprisoned and deported immediately. We shall also lobby the European Union for financial assistance to assist with our burgeoning immigration and refugee/asylum problem.

Our mission is to save this country from bad government and injustice.

Our promise is to the people of this country to make this a great nation free of fear and full of faith!… One nation under God. Amen.

5. MEMBERSHIP

5.1 Requirements for full membership:

5.1.1 Membership of the AUP shall be open to all South Africans above the age of 18,irrespective of race, colour or creed who accept its principles, policies and programmes and are prepared to abide by its constitution and rules. Interested persons who are below 18 and above 16 may attend the meetings or volunteer as lay members.

5.1.2 All other persons who have manifested a clear identification with the South African people ( and African peoples) and their struggle and are resident in South Africa may also apply for membership. 

5.1.3 Applications for membership shall be considered by the branch executive committee where such exists , and by the regional executive committee, if no branch executive committee exists.

5.1.4 The branch excutive committee or the regional executive committee may create from time to time a committee to decide on applications ,may accept or refuse any application for membership.

5.1.5 Membership cards will be issued to registered members of the AUP and to persons whose application for membership has been accepted ,subject to payment of the prescribed subscription. An applicant will be issued with an acknowledgment of provisional membership and the details of the branch and constituency area in which the applicant resides and any available information about the local branch structures. Membership of the party shall be open to all persons who qualify in terms of this clause and subscribe to this constitution and who support a multi party democratic political system for the Republic of South Africa.

5.1.6 A member of AUP will:

a. Belong to and take active part in his or her branch.
b. Offer constructive criticism of any member , official, program or any activity within the association structures.
c. To take part in elections and be elected or appointed to any committee, structure or be delegated to perform any function as agreed within the association. The Youth League “Umvuko” ( Awaken) will be subject to the same repsonsiblities and duties.

5.1.8 To this end any individual aged eighteen ( 18 ) years and above shall be eligible for membership , without discrimination based on race , gender , marital status, ethnic,tribal, economic or social origin, colour, sexual orientation , disability, religion, conscience, belief, culture, character and language…
Provided that:
5.1.8.1 He / She is a permanent resident of the Republic Of South Africa.
5.1.8.2 He/ she applies for membership in writing.
5.1.8.3 He/ She pays the annual membership fees.
5.1.8.4 He / She is not a member of any other political party.

5. 2 Suspension or termination of Membership.

5.2.1 Membership of the Party shall be suspended or terminated in the following instances:

5.2.1.1 By written resignation ,submitted to the party.
5.2.1.2 Non Payment of annual membership fees on due date. If the full prescribed annual membership fee is paid within the first six( 6) months of the following membership year, membership shall be restored as if membership fees were paid on time.
5.2.1.3 A member shall be automatically suspended if he/she is charged with a serious offence that will reflect negatively on the party as a whole. When the judicial process is completed the member will be restored. Prisoners who have been convicted of any crime may join the party but cannot hold office until their convictions are spent. This party believes in rehabilitation.

6.1.4 Duties and activities of the Branch

6.1.4.1 Branches may draft points for discussion/motions for submission to the regional executive or national executive committee.

6.1.4.2 A branch elects delegates to regional congress and no other member may be a delegate and have voting rights at a regional conference.

6.1.4.3 The branch shall have the right to nominate party candidates for election.

6.1.4.4 Branch members should actively participate in election campaigns.

6.1.5 Branch Annual General Meeting

The business of Annual General Meeting ( AGM) is to:

6.1.5.1 Confirm the minutes of the previous AGM .
6.1.5.2 Receive and consider the chairpersons report on the branch’s organisational status of the preceding financial year.
6.1.5.3 Receive and consider the treasurers report and the accounts and balance sheet for the preceding financial year;
6.1.5.4 Consider any resolutions of which notice was given;
6.1.5.5 Endorse membership lists as updated.
6.1.5.6 Consider any other relevant business.
6.1.5.7 Submit a list of the newly elected Branch Executive Committee, to the Regional council.
6.1.5.8 Elect at its AGM from registered members in the branch , a branch management committee ( BMC) comprising of the following :
6.1.5.8.1 Branch chairperson.
6.1.5.8.2 Ex Officio : Elected public representative of the Party if he/she is not elected to any of the above mentioned positions.
6.1.5.9 The Branch Executive Committee ( BEC) shall appoint two( 2) persons , namely the Chairperson and Secretary or Deputy Chairperson , and each one ( 1) of them an alternate who will act in their stead ,when the appointed person is not available , as their representatives to District and Regional Council.

6.1.6 Voting Procedures

6.1.6.1 An attendance register of registered Members present and entitled to vote shall be compiled to constitute the meeting.

6.1.6.2 The qurom at any of the meetings of the Branch shall be twenty percent ( 20%) of the registered members of the Branch present and entitled to vote, provided that sufficient and proper notice is given to ALL members of the Branch.

6.1.6.3 Registered members may vote in person only, and NO proxies or any other form of representation shall be permitted.

6.1.6.4 At any meeting of the branch , a resolution put to the vote at such a meeting shall be decided on , by a show of hands , unless the meeting decides otherwise.

6.1.6.5 During an election , by a show of hands , or any other agreed manner as decided on; each member shall be entitled to one ( 1) vote.

6.1.7 Branch Executive Committee ( BEC)

6.1.7.1 Duties and activities of a BEC is to:

6.1.7.1.1 Administer the affairs of the party within the Branch Boundaries.
6.1.7.1.2 Supply interested members / supporters with AUP information. To “conscientise”/awaken those who are seeking for answers.
6.1.7.1.3 Receive and administer membership application forms.
6.1.7.1.4 Recruit members for the party and issue membership cards and receipts.
6.1.7.1.5 Compile a Branch membership list and submit it annually to the Regional Secretary, in accordance with the requirements set by their Regional Council.
6.1.7.1.6 Collection of annual membership fees and administering the renewal of annual membership.
6.1.7.1.7 Fundraise for the Party.
